当該建設業者は、建設業法第15条第２号に規定する営業所の専任技術者が、令和５年４月には他の建設業者に雇用され、営業所に常勤して専ら職務に従事しておらず、同号に掲げる許可の基準を満たしていなかった。また、建設業法第７条第１号の規定に基づく経営業務の管理責任者が令和２年12月21日に死亡しており、同号に掲げる許可の基準を満たしていなかった。 さらに、当該建設業者が令和２年５月７日に提出した建設業法第５条及び第６条第１項の書類において、営業所の専任技術者が当該建設業者に所属しておらず、給与の支払いを受けていないなど、営業所に常勤して専らその職務に従事しないにも関わらず、同人を同法第15条第２号に規定する営業所の専任技術者として営業所に置くとするなどの虚偽の内容を記載し、令和２年６月19日に建設業の許可を受けた。
