新潟県新発田地域振興局農村整備部が令和５年８月３１日に入札を執行した「平木田柳原地区取水工第1次工事」（以下、「本件工事」という。）の指名競争入札に関し、新潟県新発田地域振興局元農村整備部長が、新発田市の建設会社の顧問に対し本件工事に関する秘密事項である予定価格等の教示をし、株式会社小野組の元取締役（以下、「元法人取締役」という。）は外２名とともに、偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、元法人取締役は、刑法第９６条の６第１項（公契約関係競売等妨害）及び同法第６０条（共同正犯）に該当し、令和６年１月２９日に新潟地方裁判所より懲役１年（執行猶予３年）の判決を受け、同年２月１４日にその刑が確定した。 このことが、建設業法第２８条第１項第２号及び第３号に該当するものと認められる。
