有限会社桑原配管工業所は、民間工事において、建設業法第３条第１項第の許可を受けないで建設業を営む者と同法施行令第１条の２第１項で定める軽微な工事の範囲を超えて、下請契約を締結した。このことが建設業法第２８条第１項第６号に該当する。 また、民間発注工事において、建設業法第２６条第３項の規定に違反して、主任技術者を専任で配置しなければならない工事であるにも関わらず、主任技術者に他の工事を兼務させ、工事現場に専任の主任技術者を配置しなかった。このことは、建設業法第２８条第１項２号に該当すると認められる。
