株式会社DAIEIは、神奈川県内における民間発注工事において、建設業法第22条第１項の規定に違反して、元請として自らが担うべき施工計画、施工体系図及び施工体制台帳の作成や、二次下請以下の下請状況の把握等を怠り、請け負った工事の主たる部分を、一定期間一括して下請業者に担わせた。 このことは、建設業法第28条第１項第４号に該当する。
