有限会社甘利造園建設は、植栽工事、捨石の据付け工事、公園設備工事等、造園緑化工事の請負、設計、施工、管理等を営む事業者である。同社の代表取締役であるＡは、同社の業務を統括するとともに労働者の安全を管理するものである。Ａは、同社の業務に関し、令和５年11月15日、長野県北佐久郡軽井沢町に所在する宿泊施設において、労働者Ｂに同施設２階屋根に溜まった落ち葉を清掃させるため、高さ６メートルある２階屋根を作業床として同作業を行わせるに当たり、労働者が同作業床の端から墜落する危険があり、かつ同作業床の端に囲い等を設けることが作業の性質上困難でなかったのに、これを設けず、もって労働者が墜落するおそれのある箇所に危険を防止するため必要な措置を講じなかった。 このことにより、有限会社甘利造園建設及び代表取締役Ａは労働安全衛生法違反により各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
