株式会社山岡組の元代表取締役が、代表取締役としての在任中に参加した奈良県三郷町での入札に関して、入札談合等関与行為の排除及び防止並びに職員による入札等の公正を害すべき行為の処罰に関する法律（平成14年法律第101号）の違反及び公契約関係競売入札妨害（刑法（明治40年法律第45号）第96条の６第１項）により、懲役１年６月（執行猶予４年）の判決を受け、その刑が確定した。 このことが、建設業法第28条第１項第２号及び第３号に該当すると認められる。
