有限会社三上産業は、令和４年１月１７日、排雪運搬用側板をダンプトラックのあおりに取り付ける作業に際し、排雪運搬用側板が荷台内側に傾き、固定措置ができなかったため、代表取締役がドラグ・ショベルのバケットで排雪運搬用側板を荷台内側から押している間、自社労働者に固定作業を行わせたところ、ダンプトラックの鳥居部分とドラグ・ショベルのバケットに挟まれ、死亡した。このことにより、労働安全衛生法第２０条第１号（労働安全衛生法規則第１５８ 条第１項）違反として、令和４年１２月２７日網走区検察庁より起訴され令和５年１月６日、網走簡易裁判所より、それぞれ、法人が罰金２０万円、役員が罰金５０万円の判決を受け令和５年１月２４日に刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものです。
