株式会社秋山重機は、同社の業務に関し、令和４年２月２３日、韮崎市内の資材置場において、使用する作業員が資材の整理中に負傷し４日以上休業したことから、所轄の甲府労働基準監督署長に対し、遅滞なく、労働者死傷病報告書を提出しなければならないのに、これを怠った。 このことにより、同社及び同社の代表取締役は、令和５年５月１０日、労働安全衛生法違反により甲府簡易裁判所から各々罰金２０万円の略式命令を受け、その刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
