株式会社大達土木は、東京都内の公共工事において、一次下請業者が請け負った建設工事を一括して二次下請業者に請け負わせていた事実を把握しながら、建設業法第24条の７第１項及び第２項に違反して、これらの下請業者に対する指導等を怠った。 また、別の東京都内の複数の公共工事において、建設業法第24条の８第１項及び第４項に規定する施工体制台帳及び施工体系図について、事実と異なる施工体制台帳及び施工体系図を作成し、その写しを発注者に提出した。 さらに、別の東京都内の公共工事において、建設業法第24条の８第１項に規定する施工体制台帳について、事実と異なる施工体制台帳を作成し、その写しを発注者に提出した。 これらのことが、建設業法第28条第３項に該当する。
