有限会社田口板金は、令和３年４月２６日、印西市大森所在の倉庫の屋根のスレート張替作業を行うにあたり、踏み抜きにより労働者が墜落するおそれがあったのに、労働者の危険を防止するための措置を講じなかった。 当該事実に基づき、佐倉簡易裁判所から令和３年９月３０日付け令和３年（い）第２９１号略式命令において、労働安全衛生法違反により、同法人及び同代表取締役が罰金２０万円の刑に処せられた。 このことが、法第２８条第１項第３号に該当すると認められる。
