株式会社白高商事は、宮城県刈田郡蔵王町宮字松ヶ丘２１９番地７号で建設業を営んでいるところ、同社元取締役は令和４年９月２日に山形県東置賜群川西町内の解体工事現場で油圧ショベルによる整地作業を行わせるに当たり、誘導者を配置してその者に同油圧ショベルを誘導させるなどの危険を防止するため必要な措置を講じなかった。これにより、労働者を同油圧ショベルとコンテナの間に挟むなどし、同社は令和５年１２月７日に大河原簡易裁判所から、労働安全衛生法（昭和４７年法律第５７号）違反により罰金刑の略式命令を受け、その刑が確定した。 このことは、建設業法第２８条第１項第３号に該当する。
