寺川塗装店は、審査基準日（事業年度終了の日）が令和2年12月31日における経営事項審査（以下、「経審」という。）を受審した後、継続して経審を受審することなく、この経審の有効期限である令和4年7月31日を経過した後に、令和5年7月27日付け香美町発注の「町営森住宅外壁修繕工事（31号・32号棟、33号・34号・35号棟、36号・37号棟）」の契約を締結した。このことは、建設業法第27条の23第1項及び同法施行規則第18条の2に違反した契約締結である。
