株式会社ＭＴテックは、建設業許可を有していないにもかかわらず、東京都内の公共工事において、元請人に対し自ら偽造した建設業許可通知の写しを提出し、建設業許可を受けた建設業者と誤認させ、建設業法施行令第１条の２第１項の規定に定める金額以上の工事を請け負った。 このことが建設業法第３条第１項の規定に違反し、同法第28条第２項第２号及び同条３項に該当する。
