有限会社菅原工務店及び同社代表取締役は、南秋田郡井川町坂本地内の工事現場において、当該工事の下請負人である有限会社小松板金の労働者に、建物の屋根を作業床として屋根材の取付作業を行わせるに当たり、同作業床が地上から約５．１６メートルの高さに位置し、墜落により労働者に危険を及ぼすおそれのある場所であったにもかかわらず、同所に囲い、手すり、覆い等を設けず、下請負人の労働者の労働災害を防止するための必要な措置を講じなかった。 これにより、同社及び同社代表取締役は労働安全衛生法違反の罪によりそれぞれ罰金２０万円の略式命令を受け、令和５年１０月１１日までにその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
