Kaminai Construction Co., Ltd. was directly contracted by Kiso Wide Area Union as the representative of a joint enterprise for the demolition work of an old furnace facility in Kiso Town, Kiso District, Nagano Prefecture. On January 20, 2021, during demolition work, a subcontracted worker used the third-floor corridor at the construction site as a work platform and was dropping waste materials from a missing section of the handrail. The worker fell approximately 9.3 meters from the missing section of the handrail to the first-floor floor and died. Following this incident, the company and one of its employees received summary orders on December 15, 2021, from Kiso Fukushima Summary Court for violations of the Industrial Safety and Health Act, each fined 300,000 yen. Their sentences were finalized. It is recognized that this constitutes a violation of Article 28, Paragraph 1, Item 3 of the Construction Business Act.

神稲建設株式会社が木曽広域連合から共同企業体の代表者として直接請け負った、長野県木曽郡木曽町における旧炉施設解体工事において、令和３年１月２０日、解体作業中に、下請負人の労働者が本工事現場３階通路を作業床とし、同通路の手すりの欠損部分から廃材を投下する作業を行っていたところ、同通路の手すり欠損部分から高さ約９．３ｍ下の１階床に墜落し死亡した。 この事故をうけ、手すりの欠損部分からの墜落により労働者に危険を及ぼす恐れがあったのに、手すりの欠損部分に囲い、手すり、覆い等を設けず、もって請負人の労働者の労働災害を防止するため必要な措置を講じなかったとして、同社及び同社社員１名が、令和３年１２月１５日、木曽福島簡易裁判所より労働安全衛生法違反による略式命令（それぞれ罰金３０万円）を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
