令和４年１月18日、東京都江東区内の工事現場で、高さ15.5メートルの足場から労働者が墜落し、死亡した。磐梯興業株式会社の職員であり、同工事の職長かつ足場の組立て等作業主任者は、足場の組立て等作業主任者が構ずべき、労働者の要求性能墜落制止用器具の使用状況の監視を怠っていたものである。 このことにより、令和５年１月25日に東京簡易裁判所から、同社及び同社の前記職員は労働安全衛生法違反により、それぞれ罰金刑の略式命令を受け、いずれもその刑が確定した。 このことが、建設業法第28条第１項第３号に該当する。
