被処分者は、宅地等の売買の媒介を行ったのに、買主（宅地建物取引業者）に対し重要事項説明書を交付しなかった。このことは法第35条第１項に違反し、法第65条第２項第２号の業務停止処分の事由に該当する。 また、被処分者は、法第46条第１項に基づき定められた国土交通大臣の定める報酬に係る告示の内容を誤認し、報酬に係る告示で定める額を超えて依頼者から媒介に係る報酬を受領した。このことは法第46条第２項に違反し、法第65条第２項第２号の業務停止処分の事由に該当する。
