株式会社新興プラント工業は、 1 建設業法第26条第3項及び建設業法施行令第27条により専任の主任技術者の配置が義務づけられている民間発注 のとび・土工・コンクリート工事に、建設業第15条第2項に規定する営業所の専任者を主任技術者として配置した。 2 同様に民間発注の管工事において、建設業第15条第2項に規定する営業所の専任者を主任技術者として配置した。 上記1、2は、建設業法第26条第3項に違反し、同法第28条第1項第2号に該当する。 3 更に、上記管工事と工期が重複する他の工事に同専任者を主任技術者として配置した。 このことは、建設業法第7条第2項及び同法第26条第3項に違反し、同法第28条第1号第2号に該当する。 4 民間発注の機械器具設置工事において、建設業法第26条第1項に違反し、資格要件を満たさない2名を主任技術者 として配置した。 5 同様に、民間発注のとび・土工・コンクリート工事において、建設業法第26条第1項に違反し、資格要件を満たさ ない2名を主任技術者として配置した。 上記4、5は、建設業法第28条第1項第2号に該当する。
